By engaging our services, you (“the Client,” “you,” or “your”) agree to be bound by these Terms and Conditions, which outline the scope of our services, guarantees, and the responsibilities of all parties involved.
ThermoPest is a registered company in England and Wales (Company Number: 16317222), specialising in bed bug eradication and general pest control through both in-house treatments and subcontracted services.
1. Services Provided
1.1 Direct Services: ThermoPest provides heat treatment and pest control services to eradicate pests, including but not limited to bed bugs, using industry-standard techniques and equipment.
1.2 Subcontracted Services: Where necessary, ThermoPest may subcontract pest control services to approved, qualified contractors within our network. These subcontractors are vetted to ensure compliance with our quality standards.
1.3 Service Scope: The specific treatment plan (e.g., heat treatment, chemical treatment, or a combination) will be agreed upon with the Client prior to commencement. For subcontracted services, ThermoPest acts as a facilitator, connecting Clients with contractors, while overseeing the service process.
2. Guarantee Clause
2.1 Definition of Guarantee: The term “guarantee” reflects our commitment to delivering effective pest control solutions, whether performed by ThermoPest directly or through our approved subcontractors. While we aim for complete pest eradication, success may depend on factors such as infestation severity, property access, and Client cooperation. Complete eradication is not always guaranteed.
2.2 60-Day Return Guarantee:
- Scope: This guarantee applies to bed bug and pest treatments completed by ThermoPest or our subcontractors within the last 60 days, where a comprehensive heat treatment or agreed-upon pest control method was applied to all required areas.
- Return Visit Procedure:
- If live pests (e.g., bed bugs) are reported within 60 days of the initial treatment, ThermoPest or the relevant subcontractor will arrange a return visit, provided the Client supplies evidence of an active infestation (e.g., video, photos, or pests captured in traps).
- The return visit may include targeted chemical treatment or additional heat treatment, at our discretion, to address persistent pest issues.
- Comprehensive Treatment Requirement: The guarantee applies only to properties where the agreed treatment (e.g., full heat treatment) was completed across all necessary areas. Partial treatments due to Client restrictions or other limitations void this guarantee.
- Multi-Occupancy Buildings: The guarantee does not apply to multi-occupancy properties (e.g., flats, apartments, hotels, or terraced houses) where the entire building was not treated, particularly if untreated neighboring areas harbor active infestations.
2.3 Client Responsibilities:
- Notify ThermoPest or the subcontractor of any pest concerns within the 60-day guarantee period.
- Provide full access to the property for return visits and follow-up treatments.
- Submit clear evidence of an active infestation (e.g., photos or videos of live pests).
- Adhere to all post-treatment instructions provided by ThermoPest or the subcontractor.
2.4 Exclusions from Guarantee:
- New infestations introduced after the initial treatment.
- Cases where Clients fail to follow post-treatment guidelines.
- Treatments impacted by structural issues, inaccessible areas, or Client-imposed limitations.
- Properties where only partial treatment was performed due to Client preference or restrictions.
2.5 Limitations:
- The 60-Day Return Guarantee is non-transferable and applies only to the original Client who received the initial treatment.
- Additional costs may apply for return visits if the guarantee conditions are not met.
3. Client Obligations
3.1 Preparation: Clients must prepare the property as instructed (e.g., removing clutter, vacating during treatment) to ensure effective service delivery. Failure to prepare may result in treatment delays or cancellation without refund.
3.2 Access: Clients must provide full access to the property at the agreed time. ThermoPest or subcontractors are not liable for delays caused by restricted access.
3.3 Payment: Full payment is due as agreed in the service contract, typically upon completion of the initial treatment, unless otherwise stated. Late payments may incur additional fees.
4. Subcontracting
4.1 ThermoPest reserves the right to subcontract services to approved contractors when deemed necessary.
4.2 While ThermoPest oversees subcontractor performance, the subcontractor remains responsible for the execution of their work. Any disputes arising from subcontracted services should be reported to ThermoPest for resolution.
5. Liability
5.1 ThermoPest and its subcontractors will exercise reasonable care during treatments but are not liable for:
- Damage to property caused by pre-existing conditions (e.g., pest-related damage).
- Loss or damage to items not removed as per preparation instructions.
- Health issues arising from failure to follow safety guidelines (e.g., re-entering the property too soon).
5.2 Our liability is limited to the cost of the service provided. We are not responsible for indirect or consequential losses.
6. Cancellations and Refunds
6.1 Cancellations: Clients may cancel bookings with at least 48 hours’ notice for a full refund. Cancellations within 48 hours may incur a fee.
6.2 Refunds: Refunds are not provided for completed treatments unless ThermoPest or its subcontractor fails to deliver the agreed service due to negligence.
7. Additional Services
7.1 ThermoPest may offer promotional pest control solutions (e.g., non-bed bug treatments) outside the scope of this guarantee. These services will be subject to separate terms, which will be provided at the time of booking.
8. Governing Law
8.1 These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
